In June 2024 the EU Board of Appeal (BoA) issued its decision on an appeal filed against the EUIPO’s 2023 refusal of an opposition alleging likelihood of confusion between two short, stylised trade marks comprising the same two letters. David Birchall discusses how Italian entity SEVEN SPA (Seven) had opposed the class 18 element of an application filed by Swiss entity Jakob Simon International GmbH (Jakob) to register a stylised mark as an EU trade mark in respect of, among other goods, “Luggage and carrying bags; handbags; toiletry bags; wallets” in class 18, alleging likelihood of confusion.
